Welcome to Mama, Dada and Me Adventures ("the App"). By accessing or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

1. Who Operates This App

2. Acceptance of Terms

By creating an account or using the App, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of a minor, you represent that you are the parent or legal guardian of that child.

3. Description of Service

Mama, Dada and Me Adventures is a family storytelling application that allows parents and guardians to:

  • Generate personalized, AI-powered bedtime stories featuring your family as characters
  • Read stories in English, Spanish, and 30+ additional languages with voiceover
  • Create AI illustrations on every page featuring your family's characters
  • Listen to stories with text-to-speech narration using premium AI voices or custom voice clones
  • Choose from 41+ adventure themes and locations (parks, zoos, beaches, space, and more)
  • Create Chapter Books — 20-page, 5-chapter stories for ages 6-10
  • Add pets as story co-stars with customizable costumes
  • Track reading progress with star rewards, badges, reading streaks, and a Reading Passport
  • Take comprehension quizzes and explore vocabulary after each story
  • Save and download stories as PDF books
  • Manage multiple child profiles with age-appropriate reading levels (ages 2-10)
  • Add extended family members (grandparents, aunts, uncles) as story characters
  • Customize family profiles with children's names, ages, photos, and character descriptions

4. User Accounts

  • You may sign in using Apple Sign In, email and password, or other supported authentication methods
  • You are responsible for maintaining the security of your account
  • You must not share your account credentials with others
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account

5. Subscription Plans and Payments

The App offers the following subscription tiers:

  • Free: 2 stories per day, 12 adventure themes, English & Spanish stories, browser voice narration, 2 child profiles, AI illustrations on every page, comprehension quizzes & vocabulary, star rewards & Reading Passport, 4 reading levels (ages 2-10)
  • Premium ($9.99/month or $69.99/year): Unlimited stories, all 41+ adventure themes, secret adventures (unlockable), 6 premium AI narrator voices, 32 languages with voiceover, Create Your Own Adventure, pets as story co-stars, unlimited child profiles, 3 custom voice clones (Mama, Dada & more), Chapter Books — 20-page stories (3/month), comprehension quizzes & vocabulary, star rewards & Reading Passport, and early access to new features
  • Ultimate ($19.99/month or $149.99/year): Everything in Premium, plus solo child + pet adventures, all adventure locations for pet stories, Create Your Own pet adventures, 6 custom voice clones (whole family), add grandparents/aunts/uncles as characters, exclusive pet costumes, download stories as PDF books, 10 Chapter Books per month (20 pages), Secret Pet Chapter Books (surprise unlocks), and priority story generation

5a. Payment Processing

Subscriptions may be processed through Apple's App Store (for iOS users) or through Stripe (for web users). By subscribing, you agree to the applicable payment processor's terms of service.

Apple App Store: Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Stripe (Web): Payment will be charged to the payment method you provide at checkout. Subscription automatically renews unless canceled before the end of the current billing period. You can manage and cancel your subscriptions through the App's account settings.

5b. Refunds

For Apple App Store purchases, refund requests must be submitted through Apple. For Stripe purchases, please contact us at [email protected] for refund inquiries.

5c. Referral Program

The App may offer a referral program where users can invite friends and earn rewards (such as free trial days or bonus stars). Referral rewards are subject to change and may be modified or discontinued at any time. Abuse of the referral system (e.g., creating fake accounts) may result in account suspension.

6. Voice Cloning

Premium and Ultimate subscribers may record voice samples to create custom AI voice clones for story narration. By recording your voice, you consent to our processing of your voice data solely for the purpose of creating a personalized voice clone within the App. Voice samples are stored securely and processed by our voice cloning service provider (ElevenLabs). They are not shared with any other third parties. You may delete your voice clones at any time through the App's Voice Settings page.

You must only record your own voice or the voice of someone who has given you explicit consent. Recording another person's voice without their consent is a violation of these Terms.

7. Rewards System

The App includes a rewards system designed to encourage reading. Features include:

  • Stars: Earned by completing stories, quizzes, and maintaining reading streaks. Stars can be spent on in-app items such as streak shields and bonus stories.
  • Badges: Awarded for milestones (story count, chapter book completions, streaks, exploration, and more). Badges are cosmetic achievements and hold no monetary value.
  • Reading Passport: Monthly stamps earned by reading consistently. Completing 12 months earns a special badge.
  • Pets & Costumes: Virtual pet companions and costumes unlocked through stars and milestones.

Rewards, stars, badges, and virtual items have no real-world monetary value and cannot be exchanged, transferred, or redeemed for cash. We reserve the right to modify the rewards system, including star values, badge requirements, and available items, at any time.

8. Content Ownership and License

8a. Your Content

You retain ownership of the personal information you provide, including children's names, family details, photos, and voice recordings. By providing this content, you grant us a limited license to use it solely for the purpose of generating personalized stories, illustrations, and narration within the App.

8b. Generated Content

Stories, illustrations, and audio narration generated by the App are created using AI services. You are granted a personal, non-exclusive, non-transferable license to use generated content for personal, non-commercial purposes (reading with your family, printing for personal use, sharing with family members, downloading as PDF for personal use).

You may not use generated content for commercial purposes, including but not limited to selling printed books, licensing illustrations, redistributing stories, or using generated content in other applications or services.

8c. Story Downloads

The App allows you to download stories as PDF files for personal, non-commercial use. Downloaded stories may contain your children's first names and AI-generated illustrations based on your family's character descriptions. You are responsible for how you store and distribute any downloaded content.

8d. App Content

The App's design, code, branding, illustrations, and interface are owned by The Mama, Dada & Me Adventures Team and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App.

9. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to generate inappropriate, harmful, or offensive content through story prompts
  • Upload content (photos, voice recordings) that you do not have the right to use
  • Attempt to reverse-engineer, decompile, or hack the App
  • Use automated tools to access the App (bots, scrapers)
  • Interfere with the App's operation or other users' experience
  • Create multiple accounts to circumvent subscription limits or abuse free tier allowances
  • Record or use another person's voice without their explicit consent
  • Abuse the referral program by creating fake accounts or using fraudulent referral methods
  • Attempt to manipulate the rewards system through automated or fraudulent means

10. AI-Generated Content Disclaimer

Stories, illustrations, comprehension quizzes, and vocabulary content are generated by artificial intelligence. While we strive for high-quality, age-appropriate content tailored to your child's reading level, AI-generated content may occasionally contain unexpected variations, inaccuracies, or content that does not fully match your expectations. We recommend that parents review stories before reading them with young children. We are not responsible for any AI-generated content that does not meet your expectations.

Translations into languages beyond English and Spanish are also AI-generated and may contain errors. We do not guarantee the accuracy of AI-generated translations.

11. Children's Privacy (COPPA Compliance)

The App is designed to be used by parents and guardians on behalf of their children. We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13. All account creation and data input is performed by the parent or guardian. 12. Service Availability

We strive to keep the App available at all times but do not guarantee uninterrupted service. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Story generation, illustration creation, voice cloning, and text-to-speech narration depend on third-party AI services which may experience occasional downtime or degraded performance.

13. Limitation of Liability

To the maximum extent permitted by law, The Mama, Dada & Me Adventures Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, loss of generated content, or interruption of service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the App in the 12 months preceding the claim.

14. Account Deletion

You may delete your account and all associated data at any time using the "Delete My Account" button in the Family Profile page, or by contacting us at [email protected]. Upon account deletion, all personal data, stories, voice recordings, family photos, child profiles, and rewards data will be permanently removed within 30 days. This action cannot be undone.

15. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, abuse the rewards system, or engage in fraudulent activity. Upon termination, your right to use the App ceases immediately, and we may delete your data in accordance with our Privacy Policy.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App with a new "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.
